Not medical advice. GeneticPT is a wellness and educational tool. It does not diagnose, treat, or prevent any condition and is not a substitute for professional medical care. Consult a physician before beginning any exercise or nutrition program, especially if you have any injury, health condition, are pregnant, or are unsure whether activity is safe for you.

These Terms of Service ("Terms") govern your use of GeneticPT (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

2. What the Service is (and is not)

The Service analyzes a set of fitness-related genetic markers from a raw DNA file you provide, together with information you enter, to generate personalized wellness and educational training and nutrition suggestions.
The Service is not medical, diagnostic, or healthcare advice; it does not establish a doctor–patient or professional-client relationship; and genetic influence on fitness is small and probabilistic, not deterministic.

3. Health disclaimer and assumption of risk

Exercise and dietary changes carry inherent risks, including injury. You should obtain clearance from a qualified healthcare professional before starting.
You are solely responsible for how you use any plan or information from the Service, and you assume all risks associated with physical activity and dietary changes you undertake.
Stop and seek medical attention if you experience pain, dizziness, or any concerning symptoms.

4. Your DNA data and consent

You represent that any DNA data you upload is your own, or that you are legally authorized to submit and process it.
You consent to our processing of your genetic information as described in our Privacy Policy, solely to generate your plan. Your raw genome is processed in memory and not stored.

5. Accounts

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity under your account.

6. Acceptable use

You agree not to misuse the Service, including by uploading data you are not authorized to use, attempting to disrupt or reverse-engineer the Service, or using it for any unlawful purpose.

7. Payments

During the beta the Service may be provided free of charge. If paid plans are offered, applicable pricing and billing terms will be presented at checkout and processed by our payment provider.

8. Intellectual property

The Service, including its underlying engine, content, and software, is owned by GeneticPT and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the plans we generate for you for your own personal, non-commercial use.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service or any results will be accurate, reliable, or meet your expectations.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GeneticPT AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM PERSONAL INJURY, use of or inability to use the Service, or reliance on any plan or information provided. Our total liability for any claim will not exceed the greater of the amount you paid us in the prior twelve months or USD $50.

11. Indemnification

You agree to indemnify and hold harmless GeneticPT from claims arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party (including submitting DNA data you were not authorized to submit).

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of [YOUR STATE], without regard to conflict-of-laws rules. Disputes will be resolved in the courts located in [YOUR COUNTY/STATE]. (To be finalized with your attorney.)

14. Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.
